ACC law has been amended with a view to preventing repetition of its misapplication and harassment of people politically as was done during the caretaker government.
At a briefing Tuesday, Law Minister Barrister Shafique Ahmed said that there is widespread criticism for ACC law being misused during the caretaker government in filing false cases many of which were not tenable eventually.
He said in last two years ACC was controlled from the behind to harass politicians by a quarter; law was abused violating independence of the commission.
He dismissed allegation that deletion of section 408 of Penal Code from the schedule of ACC law has precluded the commission from curbing corruption of government officials saying that by deletion of the section, the commission has got rid of workload as regards to private sector corruption, to be more concentrated to government sector corruption.
Shafique Ahmed clarified that section 409 of the Penal Code is very much in the schedule of ACC providing for power to investigate corruption committed through criminal breach of trust of money and property by officials of government and statutory bodies.
He said this amendment has been okayed by the cabinet
and it will be placed before the parliament which may send it to standing committee to be examined again before ratification.

Terming ACC new chairman (retd) secretary Golam Rahman an honest person he said the commission under him will function more effectively and transparently in curbing real corrupts.
He gave intimation that the government may send a proposal to the ACC to examine merits of the cases against politicians followed by withdrawal of false cases as ACC has the authority to withdraw fake cases.
Replying to query about cases against Khaleda Zia and her sons he said he cannot comment about any particular person saying that it is out of question to withdraw all cases because some cases are sure to be genuine.
By May 17 the committees comprising District Magistrates will scrutinize falsity of cases against politicians and then those will be examined by the ministry prior to forwarding proposal to ACC for their waiver, he said.
At this stage the law minister said formation of investigation agency and prosecution cell and constitution of tribunal for trial of war criminals will be completed within June. But it will take time to start trial because prior to that investigation, charge-sheet, document and evidence have to be ready.
