All initiative to bring Awami League President Sheikh
Hasina and BNP Chairperson Khaleda Zia in a dialogue will
be foiled if the government opposes the bail of Sheikh
Hasina.
This was stated by both Sheikh Hasina and Khaleda Zia's counsel Barrister Rafiqul Haque following the government lawyer's opposition during the hearing of bail petition of Sheikh Hasina in businessman Noor Ali's extortion case on Wednesday.
Rafiqul Haque said that in the morning when he talked to Law Adviser Hassan Ariff, the Adviser suggested to secure bails of Sheikh Hasina in all pending cases. But when hearing of a bail petition really took place, the government counsel opposed the bail rendering the government's position contradictory, he added.
He stated "The government is trying to bring two leaders together in a dialogue while its lawyers are opposing bail of Sheikh Hasina. If Hasina does not get bail in all cases then how will she be placed on par with freed Khaleda Zia?"
Sheikh Hasina should come
back home with clean hand as a
free person getting bail in all cases, the counsel said
adding that only on ground of such government's opposition
against her bail Sheikh Hasina would tell " I shall not
sit with Khaleda Zia for dialogue."
Referring to the bails of Tarique Rahman, Sigma Huda, Salauddin Quader Chowdhury and others, the senior counsel submitted her arguments in favour of Hasina's bail.
About government opposition in Hasina's bail, Additional Attorney General Mansur Habib said "In Azam J Chowdhury's case we did not oppose bail of Sheikh Hasina but in the present case we have been compelled to oppose. In that case there was no instruction from above but in this case we are instructed to give opposition against her bail."
Meanwhile, the bail petitions in NIKO and barge-mounted corruption cases Hasina were refused to be heard by a Division Bench of Justice Fazlur Rahman and Justice Abdul Awal; these petitions are now set to be heard by another Bench.
The government counsel also argued that bail is prayed in Noor Ali's cases on health ground but the medical certificate produced before the Court is backdated and an updated medical report is necessary in this regard. He said whether Hasina needs bail for illness or for coming back on occasion of the coming parliamentary election is to be determined first while granting bail in the pending cases.
However, the Court fixed September 29 for passing order on bail petition in Noor Ali's case.
